1. General

BMapp AG takes the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory Swiss data protection regulations, the European General Data Protection Regulation (GDPR) and this privacy policy. The use of our websites (bmapp.ch) is generally possible without providing personal data. Insofar as personal data (e.g. name, address or e-mail addresses) is collected on our website, this is always done on a voluntary basis as far as possible (contact via contact form). This data will not be passed on to third parties without your express consent. We would like to point out that data transmission via Internet (e.g. when communicating by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.

The legal basis for the processing of personal data in this context is Art. 6 para. 1 lit. c GDPR and Art. 6 para. 1 lit. f GDPR. Our legitimate interest is the management of the cookies and similar technologies used and the related consents.

The provision of personal data is neither contractually required nor necessary for the conclusion of a contract. You are not obliged to provide the personal data. If you do not provide the personal data, we will not be able to manage your consents.

2. Collection of personal data

In principle, we only collect personal data if it is necessary for the provision of the specific service.

You can visit our website without providing any personal information. We only store access data without personal reference, such as the name of your Internet service provider and your Internet browser, the page from which you visit us, the date and duration of your visit or the name of the requested file. This data is analyzed exclusively to improve our offer and does not allow any conclusions to be drawn about you as a person.

Personal data that indicates the identity of the customer, such as name, address, postal address, delivery address, telephone number or e-mail address, is only collected on our websites if you voluntarily provide it to us when placing an order, registering for an event or webinar, downloading information, license keys or software, entering support tickets or registering for our newsletter, or if you use the website’s contact function or contact us in any other way, for example by e-mail. When you order goods, we use the data you provide without your separate consent exclusively to fulfill and process your order.

The customer’s data will only be used to send a newsletter or mailings with the customer’s separate prior consent. This consent can be revoked at any time without giving reasons with effect for the future.

3. Use of personal data

Mandatory fields and voluntary information
Please note that there are mandatory fields for all data collection via the website. These are marked with an asterisk and must be entered to process your request. All other information is voluntary. If you also provide information in the other fields, this will be analyzed for statistical purposes and to improve our offer.

Earmarking
Personal data that you transmit to us will be used for the purposes for which you have sent it to us. These are, for example, the processing of your request, the processing of your order or the confirmation of your participation in an event or webinar.

Use for advertising purposes
If you have expressly consented to use for advertising purposes, we will also use your personal data for information letters in order to send you current information from time to time, such as invitations to events or webinars, information on trends and current topics, or news on our services and products, by post and/or e-mail.

4. Disclosure of personal data to third parties

Your data will not be passed on unless BMapp AG is legally obliged to do so (e.g. request from an investigating authority) or authorized to do so (e.g. as part of commissioned data processing), or you have expressly consented to it being passed on to third parties. Data is passed on to third parties in particular if this is necessary for the fulfillment and processing of the contract. These third parties are of course also obliged to protect your data and to use it only for the specified purpose. Furthermore, they are obliged to treat the data in accordance with this data protection declaration and the applicable legal situation.

5. Transfer of personal data abroad

We are also entitled to transfer your personal data to third-party companies (contracted service providers) abroad if this is expedient for the data processing described in this privacy policy. They are obliged to protect data to the same extent as we are. If the level of data protection in a country does not correspond to that in Switzerland, we contractually ensure that the protection of your personal data corresponds to that in Switzerland at all times.

6. Right to information, deletion, blocking

You have the right to free information about your stored personal data at any time, as well as the right to correct, block or delete this data, insofar as this is possible in accordance with applicable law (e.g. retention obligation).

7. Data security

Your personal data that is exchanged with us via the website is always transmitted in encrypted form, which corresponds to the current state of the art. We use technical and organizational measures to secure our systems against loss, destruction, access, modification or dissemination of your data by unauthorized persons.

8. Use of cookies

We use cookies on various pages to make visiting our website attractive and to enable the use of certain functions. These are small text files with configuration information that are stored on your end device.

Some of the cookies we use are deleted again after the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your end device and enable us to recognize your browser on your next visit (persistent cookies). Yes, I have taken note of the privacy policy and would like to receive regular information from BMapp AG by e-mail about events, webinars, trends, topics, products and services and agree that my transmitted data may be used for market and customer analyses (possibly with other collected data) and subsequent advertising. I am aware that I can revoke my consent at any time with effect for the future.

10. Google analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there.

We would like to point out that on this website Google Analytics has been extended by the code “anonymizeIp” in order to ensure an anonymized collection of IP addresses (so-called IP masking).

Google will use this information on behalf of the operator of this website for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. If you have consented to your web and app browsing history being linked by Google to your Google account and information from your Google account being used to personalize ads, Google will use your data together with Google Analytics data to create target group lists for cross-device remarketing. For this purpose, Google Analytics first collects your Google-authenticated ID on our website, which is linked to your Google account (i.e. personal data). Google Analytics will then temporarily link your ID to your Google Analytics data in order to optimize our target groups.

If you do not agree to this, you can turn it off by making the appropriate settings in the “My account” section of your Google account.

This website also uses the “demographic characteristics” function of Google Analytics. This allows reports to be created that contain information on the age, gender and interests of the site visitors. This data comes from interest-based advertising from Google and from visitor data from third-party providers. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as described in the section “Objection to data collection”.

11. Use of Google AdWords

As an AdWords customer, we also use Google Conversion Tracking, an advertising service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google AdWords places a cookie on your computer/mobile device (“conversion cookie”) if you have reached our website via a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. If you visit other websites and then come to our website, we and Google can recognize that someone clicked on the ad and was redirected to our website if the cookie has not yet expired. Each AdWords customer receives a different cookie. Cookies can therefore not be tracked via the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers find out the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information with which users can be personally identified. If you do not wish to participate in the tracking process, you can also reject the setting of a cookie required for this – for example, by using a browser setting that generally deactivates the automatic setting of cookies. You can also deactivate cookies for conversion tracking by setting your browser so that cookies from the domain https://www.google.de/adwords/ are blocked.

12. Data collection of other service providers in the area of usage-based online advertising

We use cookies to automatically evaluate information known to us about your usage behavior on our websites. For this purpose, user-specific historical and future data available to us can be linked on an ongoing basis using various analysis tools and user behaviour can be analyzed, aggregated, pseudonymized and anonymized across all offers. We may use publicly available data or data from third-party providers to improve our database. The findings from your use of our offer can be used and exploited by other participating companies as part of the analysis of user behavior. Such data processing is primarily carried out with pseudonymized or anonymized data. The processing is carried out in particular for the purpose of showing you personalized advertising on one of our websites.

We are entitled to commission third parties with the technical processing of advertising measures and advertising for ourselves and are entitled to pass on your data for this purpose. You have the option to object to the use of cookies at any time, as mentioned in section 8.

13. LinkedIn

Our pages use LinkedIn functions. Data is also transmitted to LinkedIn. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by LinkedIn. 14. YouTube

Our pages use YouTube functions. Data is also transmitted to YouTube. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by YouTube. 15. Notes on external links

The web pages contain links to third-party websites (“external links”) over whose content and design BMapp AG has no influence. The respective operator of the linked website is solely responsible for the content and accuracy of the information provided there. At the time of linking, BMapp AG was not aware of any legal violations. BMapp AG has no influence whatsoever on the current and future content of the linked websites. The inclusion of external links does not mean that BMapp AG endorses the content of third parties accessible via these links. BMapp AG cannot reasonably be expected to monitor and check external links without specific indications of possible legal violations. However, if we become aware of any legal violations, such external links will be deleted immediately.

16. Changes to the data protection policy

The data controller reserves the right to make changes to this privacy policy at any time by informing its users accordingly on this page. Users are therefore advised to visit this page regularly and to check the date of the last change indicated at the bottom of the page. If a user rejects a change to the privacy policy, they may no longer use this application and may request the controller to delete their personal data. Unless otherwise stated, the current privacy policy applies to all personal data that the controller has stored about a user.
